Employer Nominated Scheme Visa to Australia



This is an employer-sponsored visa, also referred to as the Employer Nominated Scheme. People arriving in Australia as Permanent Residents under the Employer Nomination Scheme must have a job waiting for them. Their Australian employers must be their sponsor. If the employer is in regional Australia, you can apply for the Regional Sponsored Migration Scheme.

The process is detailed and needs much research—the process is described as follows.

 

1. Requirements for an employer:

  • The employer pays the appropriate fee, and must prove that it has a need for a paid employee; 
  • The business must be located in Australia and is operated by the employer; 
  • The position need to be filled by a person who is 'highly-skilled'; and, if required, the person is eligible for any mandatory licensing, registration or professional body membership; 
  • The position must be full time and the employment contract must be for a minimum of three years and renewable;  
  • The employer has an acceptable record of training or if the position is in a new business the employer needs to make acceptable specification for training in the years to come; 
  • The employer needs to provide evidence that it is not possible to fill the position within Australia unless the position is on the Migrant Occupations in Demand List; and 
  • The terms and conditions of the employment contract must be according to the standards for working conditions provided under Australian industrial laws.

 

2. Requirements for the visa applicant are:

 

• The applicant must have the skills related to the position;

• The applicant is a 'highly-skilled' person;

• The applicant is able to meet any mandatory licensing, registration or professional membership requirements;

• The position as outlined in the nomination is still available;

• The applicant is less than 45 years of age;

• The applicant has vocational English language ability; and

• The applicant and all family members meet the required health and character checks.
