Regional Established Business in Australia Visa to Australia

Six different visa classes comprise the permanent visa category of the Business Migration section.

The Established Business in Australia Visa to Australia is for people who have come to Australia and established a business while they were temporarily resident with a temporary long stay visa.

The Regional Established Business Visa to Australia is for people who have come to Australia and established a business while they were temporarily resident with a temporary long stay visa in a designated regional area of Australia.

The criteria for entry to Australia as a business skills migrant are complicated and individual and they are Points Tested.

Under the Regional Established Business in Australia (REBA) category, you need to:

• Be residing in Australia and hold a Business (Long Stay) subclass 457 visa;
• Have had major ownership interest in a main business in a designated area of Australia for a minimum period of two years directly prior to the application being made (and continue to have an interest of that kind);
• Be registered with a State/Territory government authority that will provide sponsorship should the application be approved;
• You or you and your spouse need to own a minimum of 10% of the value of the main business;
• You need to be actively involved in the daily running of the business;
• The business needs to be active providing goods or services to the public and not primarily speculative or passive investment purposes; and
• You may have up to two main businesses.

The Designated areas are currently:

• All of Victoria;
• South Australia;
• Tasmania;
• Australian Capital Territory;
• Northern Territory;
• New South Wales except Sydney, Newcastle and Wollongong;
• Queensland except Brisbane, Sunshine Coast and Gold Coast; and
• Western Australia except Perth metropolitan region.
