Although the department of migration did not intend it, this is a very difficult visa to obtain. You should get the help of a migration agent.
The Interdependent Partner Visa is designed for Australian Citizens or Australian Permanent Residents to bring their partner to Australia. The partner must not be a spouse or de facto partner. There are different applications for those two categories. This is true although the partners may be married in this or another juisdiction. Lesbian and gay people use this visa category. Both partners must be committed to each other in a mutual relationship and the relationship is a same-sex relationship. Both partners must be over 18 years of age and be able to demonstrate a genuine commitment to each other. The Interdependent Partner Visa is an Australian Permanent Residence visa that allows the visa holder to live and work in Australia.
You must be able to prove that:
- You have a genuine commitment to each other, to a shared life to the exclusion of any spouse or any other interdependent relationships;
- Your relationship is genuine and continuing;
- You live together and do not live separately and apart on a permanent basis;
- You and your partner have been in an interdependent relationship for a minimum period of 12 months prior to lodgement of the application, unless there are compelling or compassionate circumstances. These may include where applicants can establish that living together was not legally allowed in the country in which they had lived during the 12 months.
- You and your partner must be over 18 when you apply.
The application process is not complicated, but it must be adhered to strictly. People intending to apply in or outside Australia under the interdependent partner category go through a two-stage process. The process involves applying for a temporary visa and a permanent visa on one application form.
The first stage of the process involves the consideration of the temporary visa application.
The second stage of the process involves consideration of the permanent visa application. The commitment between the partners in the relationship needs to be proven because the visa does not involve a marriage certificate.
