This Australian visa is for Australian citizens or Australian legal residents to bring their child or children to Australia. The child or children can either be natural-born, step or adopted. The Child Visa category is for the natural child, adopted child or stepchild of a sponsor. The sponsor needs to be an Australian citizen, a permanent resident or eligible New Zealand citizen.
Where the child is overseas and was adopted after the sponsor became a permanent resident, they should apply for the Adopted Child visa category.
A permanent child visa can only be approved for a step relationship if the child’s natural or adopted parent is an Australian citizen, permanent resident or eligible New Zealand citizen, or where the step parent is no longer married to the child's parent and the step parent is legally responsible for the child by the court.
This is a complex area because many questions of fact must be resolved satisfactorily for the visa to be issued.
