The orphan child visa is designed for children who have not reached the age of 18 and have no parent to care for them in the country in which they are residing but who do have relatives in Australia. Their Australian relative must be either grandparents, brothers or sisters, aunts or uncles, (or the step equivalents).
Specifically, a person who is making an application for an orphan relative visa must have no parents to care for them because they are dead, permanently incapacitated or the location of the parents is unknown. The Australian relative who is the sponsor must be the child's brother or sister, grandparent, aunt or uncle, or niece or nephew (or step equivalents). The Australian relative who is the sponsor must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
The visa requirements for the grant of the visa specify that the child must have not yet reached the age of 18. If the child is under 18 at the time of the application but has turned 18 by the time the application is decided, they may still be granted the visa if they meet the other requirement of the visa. The child must not be married or in a de facto relationship. Consent of the child’s migration to Australia needs to be obtained from every person who has the right to decide where the child should be raised. The consent may be given in a statutory declaration or a court order. There are to be no compelling reason why the child should not live with the Australian relative.
